Abstract

Romanian Abstract: Studiul prezent se axează pe două aspecte majore care privesc atât situația politico-administrativă din România, cât și aspectul juridic al acesteia: mobilitatea înalților functionari publici și reflectarea acesteia în jurisprudența instanțelor din România. Prezentând urgența și posibilitatea de a utiliza această normă a legii ultra vires, studiul demonstrează această tendință folosind atât exemplele cât și deciziile jurdiciare. În același timp, studiul arată existența unui grad de inconsecvență în jurisprudența actuală cu privire la regimul juridic și aplicarea mobilității, inconsecvența deciziilor fiind prezentă în unele cazuri în practica instanțelor, a Înaltei Curți de Casație și Justiție.

English Abstract: The present study focuses on two major issues that concern both the political-administrative situation in Romania and the legal side of the above: the mobility of Senior Civil Servants and the reflection of this in the case law of domestic courts. Showing the emergence and the possibility of using this rule provided by the law ultra vires, the study proves this tendency using both examples and judicial decisions. At the same time the study shows the existence of some degree of inconsistency in the existing jurisprudence with regard to the legal regime and application of mobility, the inconsistency in decisions being present in some cases in the practice of the same court, the High Court of Justice and Cassation.
