Abstract

Most developing countries were characterized by significant government involvement in their economies marked by dominance of large state-owned enterprises in the past. In Contrary, India’s energy sector have always sought for Level Playing Field in the market but with the emergence of Cartelization, there is no denying that most of the PSU’s and National Oil Companies hold dominant position in the downstream sector.

This research project is an endeavour to divulge the concept of Cartelization. Creation of competitive environment itself resulted in monopolies by few dominant players. The matter of concern here is whether dominance by few players is anti-competitive. It is argued that Abuse of dominant position by an entity amounts to anti- competitive practices. In order to highlight the anti-competitive practices and its regulatory mechanism, reference of cases have been taken. This research paper will also reflect the concurrent jurisdiction of Competition Commission of India and Petroleum and Natural Gas Regulatory Board in respect of anti-competitive behavior like predatory pricing etc.. In order to solve the problem of interface between the CCI and PNGRB, the researcher emphasizes on the regulatory mechanism of the other foreign nation in the same field.
