Abstract

The authors express concern that the proposed DOJ-FTC Update to their 1995 Antitrust Guidelines for the License of Intellectual Property fail to address the substantial body of agency guidance and law that has emerged in recent years regarding the licensing of standards-essential patents (SEPs) on terms that are “fair, reasonable and non-discriminatory” (FRAND).
