Abstract

תקציר בעברית: תעשיית המזון מהחי היא מהגדולות והמצליחות בעולם. מרבית האנשים בישראל ובעולם צורכים מזון מהחי כדבר שבשגרה, מספר פעמים ביום, ואף מרבית קוראי המאמר הם לקוחותיה הוותיקים. לצד ההצלחה העצומה, התעשייה פוגעת בכמויות אדירות של בעלי חיים. מדי שנה, עשרות מיליארדים ברחבי העולם ומאות מיליונים בישראל מובאים לחיים, מוחזקים בתנאים קשים ומומתים בסיומם של חיים קצרים ואומללים.

הצרכנית הבוגרת הטיפוסית יודעת היטב שמזונה הופק בפגיעה בבעלי חיים. מנגד, אין היא יודעת מה טיב הפגיעות, היקפן וחומרתן. תעשיית המזון מהחי עמלה בשיטתיות להסתיר את הפגיעות הקשות, ומצליחה לייצר פער גדול בין הגלוי והמופשט לנסתר והמפורט. כלי חשוב בשיטה זו הוא השיווק והפרסום, שבאמצעותם שולחת התעשייה לצרכנים מסרים על מצבם החיובי של בעלי החיים, מסרי רווחה ונועם, בניגוד גמור למציאות הקשה. המאמר מציג דוגמאות רבות למסרים כאמור, בפרסומות מסחריות, באריזות מוצרים ועוד: מסרים שמרמזים על עובדות מסולפות, ומסרים תדמיתיים שמאחוריהן מגמה של סילוף אמת וטשטוש מצפוני. אחריהן יסקור המאמר את מציאות חייהם של בעלי החיים בתעשיית המזון מהחי.

המאמר מציע זווית משפטית מקורית לאתגור הפער בין המסרים והמציאות: דיני הגנת הצרכן. זווית זו מתמקדת לא בבעלי החיים, שמטבעם נעדרי כוח פוליטי ומשפטי ואינם יכולים לבקש סעד; אלא באדם הצרכן, שיכול גם יכול. באופן כללי, דיני הגנת הצרכן מבקשים לצמצם פערים בין הפרט הצרכן לבין מוכרים, במיוחד פערי מידע, כדי להפחית צריכה בלתי-מודעת, שאינה מבטאת את רצונו האמיתי של הצרכן. צרכנים שמוטעים לחשוב שמצבם של בעלי החיים ככלל נוח ונעים עלולים לבחור בניגוד להשקפותיהם וערכיהם. באמצעות דיני הגנת הצרכן מבקש המאמר לצמצם את ההטעיות והטשטוש הצרכני בקשר לבעלי חיים בתעשיית המזון מהחי, לתת לאמת להגיע לצרכנים ובכך לאפשר לצרכנים בחירה מודעת.

האדם המודרני מכור לעונג הקולינרי מהחי, אך מבועת מתמונות השחיטה. בחירותיו נערכות כעת עמוק בתוך בועת בּוּרות, שתעשיית המזון מהחי וגורמים נוספים ייצרו ומתחזקים עבורו, בועה שכאב בעלי החיים אינו חודר דרכה. דיני הגנת הצרכן הם סיכה פוטנציאלית חשובה במאמץ לפוצץ את בועת הבורות הצרכנית. עבור אלו שמנוצלים בסתר, מזון אינו רק חוויה קולינרית, ומודעות צרכנית אינה עניין משפטי גרידא; היא פשוטו כמשמעו עניין של חיים ומוות.



English Abstract: The animal food industry is one of the biggest and most successful industries in the world. Most people in Israel and in the world consume animal food on a daily basis as well as most readers of this article. This industry exploits an astonishing amount of animals. Each year billions of animals and hundreds of millions in Israel are brought alive, held in harsh conditions and eventually slaughtered at the end of their short and miserable lives.

While the typical adult consumers know their food was produced by hurting animals, they do not conceive the measure, scale and harshness of the process. The food industry systematically strives to conceal the harsh injuries and succeeds in creating a wide gap between the visible and abstract to the hidden and elaborate. One important tool in this system is marketing and advertising, through which the industry sends consumers messages about the good living conditions of animals, as opposed to the harsh reality. The article shows many examples of such messages, in commercials, product packaging and more. Those messages imply false facts and attempt to maneuver the consumers' conscious.

The article suggests an original legal angle to challenge the gap between reality and false messages: consumer law. This angle revolves not around the animals, which are derived of political and legal power and cannot seek legal aid, but around the human consumer, who can. Consumer law offers a way to bridge gaps between sellers and consumers in order to let consumers choose in accordance to their true will. The modern man is addicted to culinary pleasure but is horrified by the sight of slaughter. His choices are made within a bubble of ignorance, created and maintained by the food industry. Consumer law is a potential way of blowing the bubble of consumer ignorance. For those who are exploited behind closed doors, it is literally a matter of life and death.
