Abstract
In September of 2014, the U.S. Commission on Civil Rights published "Patient Dumping." This Commissioner Statement by Commissioner Gail Heriot (also a professor of law at the University of San Diego) was part of that report. It discusses some of the problems with EMTALA (the Emergency Medical Treatment and Labor Act). In particular, it discusses evidence that some hospitals have shut down their emergency rooms in order to avoid having to provide free services under EMTALA.
