Abstract

On July 30, 1965, President Lyndon B. Johnson and Congress established the Medicare and Medicaid programs. This article traces the evolution of administrative procedures for policy-making and adjudication in the Medicare program since its inauguration. Part II of this article provides background information on the Medicare program that is relevant to Medicare’s administrative functions. Part III traces the evolution of administrative procedures for policy-making and adjudication in the Medicare program since its inauguration. Part IV addresses how some Medicare appeals systems are not meeting the needs of the program or its beneficiaries and also providers, suppliers and contractors. Finally, Part V will explore the collaborative approaches to policy-making that have occurred since 2000 and, in particular, in the Patient Protection and Affordable Care Act.
