A Return to Disciplinary Law: The Solution to Bullying?

Abstract

תקציר בעברית: מאמר זה בוחן את האופן בו המשפט מתמודד עם התעמרות או בריונות במקום העבודה. הוא טוען, כי תופעה זו על-פי רוב מתרחשת במישור היחסים בין עובדים ועל כן מציע לראות בה תופעה הגרעינית למקום העבודה, המחייבת התמודדות ופתרון אשר גם הם אורגניים למקום העבודה. דיני המשמעת מוצעים כמנגנון העונה על פרופיל זה ומשם, פונה המאמר לתיאור ביקורתי של העבר, ההווה והעתיד של דיני המשמעת. המאמר מסיים עם המלצות להתאמות הנחוצות בדיני המשמעת כדי שהם יהפכו לכלי שימושי במיגור תופעת ההתעמרות בעבודה, במישור היחסים בין עובדים.

English Abstract: This article examines the way in which the law deals with workplace bullying. It argues that workplace bullying in fact mostly occurs between employees and therefore proposes viewing this phenomenon as a uniquely work-centered phenomenon, requiring solutions that are organic to the modern workplace. To that end, the article proposes disciplinary law as a mechanism deeply rooted in work law and puts forward a critical examination of the history and rationales of disciplinary law and the way it works today. The paper ends by proposing changes that need to be made to disciplinary law for them to become applicable to the modern workplace and effective in managing, and ultimately reducing, the prevalence of workplace bullying in the future.
