Abstract

English Abstract: In the first place, this paper shows how the anti-corruption efforts of very diverse agents converge in the Latin American region. In addition, the present study analyzes the attitude that has so far been adopted by investment arbitration regarding international corruption. The final objective of this analysis is to present a series of legal proposals that make investment arbitration a more effective tool in the fight against corruption. These proposals could be taken into account both in the reform process initiated by ICSID, and in the creation of the multilateral investment court (MIC) proposed by the European Union. As all this analysis goes, the guiding thread of international economic law is going to be intertwined with diverse threads belonging to the sphere of the Ius Constitutionale Commune in Latin America.
