Abstract

Spanish Abstract: Este ensayo, que por su carácter no es meramente descripto, sino que propone un curso de acción, y por ello lo llamamos “manifiesto,” va a explorar si el Derecho Internacional Privado puede contribuir no solo a la sistematización formal, sino también a la legitimación sustancial de las normas del sistema jurídico global.

A fin de alcanzar los objetivos propuestos, este ensayo se propone utilizar las herramientas metodológicas propias del Dipr; esto es el método conflictual, también llamado método indirecto, para tratar encontrar soluciones justas al conflicto de leyes y jurisdicciones desde una perspectiva global.

English Abstract: This paper, which is no merely descriptive, but it also proposes a curse of action, and because of tat we call it “manifest”, will explore if Private International Law can contribute not only to the formal systematization, but also to the substantive legitimation of the rules of a global system of law.

To this end, this essay will utilize the methodological tools developed by PIL, that is, mainly, the conflict of law methodology, to try to find solutions to the problems brought by conflicts of laws and jurisdiction, from a global perspective.
