Abstract

In this paper, I argue that suprarationality justifies the legal protection of religion because it marks a limit of the proper domain of any secular legal system. The legal system, after all, operates within the realm of the rational. So it should be limited to policies it can justify in rational terms. The access of human being to suprarationality must be free. Otherwise it would be not a truly human act. For this reason, nobody is to be forced to embrace the suprarational against his or her will.
