Abstract

Spanish Abstract: El presente escrito aborda el desarrollo en derecho penal internacional de la doctrina del dominio del hecho, en general, y el de la coautoría mediata, en particular, a la luz de los más recientes pronunciamientos de la propia Corte Penal Internacional, con una acuciosa y detallada comparación respecto de fallos proferidos por tribunales internacionales ad hoc, instituidos previamente a la conformación de la Corte Penal Internacional, con el fin de juzgar conductas delictivas internacionales tales como el genocidio, los crímenes de lesa humanidad y los crímenes de guerra.

English Abstract: Given the growing application of the notion of indirect perpetration through organised structures of power, this piece analyses how the ICTY, the ICTR and the ICC at the international level have resorted to this notion to justify the convictions of senior political leaders and high military commanders as principals to the crimes committed by subordinate members of their organisations.
