Abstract

English Abstract: Increasing international integration among states has led to the creation of what is called multilevel protection of fundamental rights. In Europe, such protection takes place through the protection of fundamental rights not only by the Constitutions of European States, but also by the Charter of Fundamental Rights of the European Union and by the European Convention on Human Rights. However, the existence of several protective instances does not automatically lead to greater protection of citizens’ fundamental rights. The Melloni case, in which the Court of Justice of the European Union has finally lowered the level of protection of the fundamental rights of an Italian citizen, is here analyzed. To achieve this objective, the text initially presents the concept of multi-level protection of fundamental rights; then some of the risks involved in such protection are analyzed; and finally an analysis of the Melloni case is made, showing how the lowering of the level of protection occurred.
