Abstract
תקציר בעברית: זוהי הארת פסיקה סביב החלטת בג״ץ 6547/11 מאוגוסט 2014 בעניין אבו רחמה ואח׳ נ׳ הפרקליט הצבאי הראשי. בהארת פסיקה זו אני מבקש לבקר את החלטת מותב ביהמ״ש משלושה טעמים שונים: (1) המשקל שביהמ״ש מעניק לתחקיר המבצעי שנערך סביב מותה של ג׳וואהר אבו רחמה ובייחוד סביב המבחן החדש שביהמ״ש מציג ״בדיקה הדומה במהותה לחקירה״; (2) פרשנות ביהמ״ש את מדיניות החקירות של הפצ״ר בראי החובה לכונן חקירות פליליות אגב מות אזרחים בשטחים הכבושים; (3) נקודת המפגש שבין פסיקת ביהמ״ש והמלצות ועדת טירקל בדו״ח השני שעיניינו מנגנוני הבדיקה והחקירה של ישראל ביחס לתלונות וטענות, המועלות בדבר הפרות של דיני הלחימה.
English Abstract: This is a case note surrounding the August 2014 decision of the Israeli High Court of Justice in the case of Abu Rahma et al. v. the Military Advocate General. In this note I criticize the Court's final decision looking at three different aspects of the Justices' ruling: (1) The weight the Court gives the operational debriefing that followed Jawaher Abu Rahma's killing and in particular the Court's introduction of a new standard a "debriefing that resembles an investigation"; (2) The Court's interpretation of the MAG's internal guidelines as they relate to the obligation to open a criminal investigation in cases of civilian deaths in the occupied territories; (3) The intersection between the Court's judgment and the recommendations made by the Turkel Public Commission of Inquiry in its second report on "Israel’s Mechanisms for Examining and Investigating Complaints and Claims of Violations of the Laws of Armed Conflict According to International Law."
