Spanish Abstract: El autor analiza la historica decision del Trbunal Constitutional DFederal de Alemania de 1993 en la que se declara que el aborto viola la proteccion de la garantia constitucional al derecho a la vida, al tiempo que permite al legislador legislar sobre una ley de plazos siempre que la mujer embarazada reciba el asesoramiento oportuno y un medico practique el aborto.
English Abstract: The author explores the landmark decision of the German Federal Constitutional Court of 28 May 1993, in which the Court declared that abortion violated the constitutionally guaranteed right to life. The Court also declared, however, that first-trimester abortions would not be subject to prosecution, provided that (a) the pregnant woman received counseling beforehand and (b) a medical doctor performed the procedure.
