Abstract
The crucial point for criminalization theory is to define the purpose of criminal prohibitions. Anglo-American theorists tend to focus on the harm principle, German theorists emphasize the protection of legal goods (Rechtsgüter). In contrast to these approaches, I argue that the criminal law ought to protect rights.
