Abstract
German Abstract: Chinas Antimonopolgesetz ist nun seit fast neun Jahren in Kraft. Die Durchsetzung des Gesetzes hat sich in den vergangenen Jahren rasant entwickelt. Die Wettbewerbsbehörden und die Gerichte haben das Antimonopolgesetz in vielen hochkarätigen «internationalen» Fällen (z.B. Qualcomm oder Coca-Cola/Huiyuan), aber auch rein «lokalen» Fällen in seiner ganzen Bandbreite angewendet. Oft haben die Lösungswege der Europäischen Union einen Einfluss auf die chinesische Wettbewerbspolitik und -praxis. Viele wettbewerbsrechtliche Entscheide haben jedoch ebenso einen erkennbar lokalen Einschlag.
English Abstract: The Anti-Monopoly Law has been in force for close to nine years. Enforcement of the law has developed very rapidly over the past years. The antitrust authorities and courts have applied the law in its full breadth in many high-profile "international" cases (like NDRC's investigation against Qualcomm and MOFCOM's veto of Coca-Cola's attempted takeover of Huiyuan), but also pure "local" cases. In general, European Union competition law solutions can be influential in China. But many Chinese antitrust enforcement decisions also have a distinctively local flavor.
