German Abstract: Der vorliegende Beitrag beschäftigt sich mit den rechtlichen Schranken, die das schweizerische Verfassungsrecht Behörden auferlegt, wenn diese in Abstimmungskämpfe intervenieren. Er prüft, ob ein angemessenes Regelwerk entstanden ist, das es Behörden ermöglicht, etwa bei der Verbreitung von falschen oder irreführenden Informationen zu intervenieren, während keine Verfälschung des direktdemokratischen Prozesses zulässig sein soll. Der Begriff der Behörde wird hier weit verstanden und umfasst auch öffentliche Unternehmen und Privatpersonen mit einer Funktion in einer Behörde.

English Abstract: What are the legal limits imposed by Swiss constitutional law on public authorities intervening in direct democratic processes? The paper examines to what extent an adequate balance has been found to allow public authorities to intervene where erroneous or misleading information is being spread without granting them leeway to distort the process. The concept of public authorities is understood broadly in this context, including state-owned companies and individual members of public authorities.
