Abstract

Comment on the ECJ case-law regarding the principle of continuity of legal structures in EU Law, in the context of the Reinforcing Bars cartel case. The case raised the issue of whether the European Commission could adopt sanctions for infringements of the ECSC antitrust provisions, after the expiry of the ECSC, under the powers granted by R. 1/2003, even in the absence of transitional provisions.
