Spanish Abstract: El artículo 29 de la Convención Americana de Derechos Humanos, titulado “Normas de Interpretación” ha sido considerado como la norma que consagra el principio pro homine o pro persona y las bases para la interpretación evolutiva en el sistema interamericano. También se ha afirmado que dicho artículo constituye una norma de reenvío hacia otras normas ajenas a tal Convención. El presente trabajo nota que algunas interpretaciones actuales podrían conducir a resultados incoherentes, por lo que explora caminos útiles para sentar las bases de una nueva discusión sobre la interpretación del artículo 29.
English Abstract: Article 29 of the American Convention on Human Rights is entitled “Restrictions regarding interpretation”. Most scholars, following the Inter-American Court’s reading of this provision, consider that this norm establishes the pro homine or pro persona principle, and that forth the bases for the evolutive interpretation in the Inter-American system. Some scholars argue that this provision allows the Inter-American Court to apply not only the American Convention, but also other treaties. This paper notes that some of these interpretations may lead to unsound results, so it explores possible avenues for a new discussion of the interpretation of article 29.
