תקציר בעברית: בשנים האחרונות גוברת בישראל, כמו בעולם כולו, ההכרה בחשיבותן של דרכים חלופיות ליישוב סכסוכים, במיוחד בתחומים שבהם הסכסוך הטיפוסי נוצר בין צדדים שיש ביניהם קשר עמוק וארוך טווח שעשוי להמשיך ולהתקיים גם בתום הסכסוך, כגון תחום יחסי העבודה ותחום המשפחה. הליכי גישור ופישור הם חלק בלתי נפרד מפעילותם של בתי הדין לעבודה כבר שנים לא מעטות, ויש להניח כי חלקם היחסי בפעילות הכוללת של בתי הדין רק הולך ועולה.מאמר זה עוסק בהשפעת הייצוג על תוצאות הליכי הפישור בבתי הדין לעבודה ובהשפעת השימוש במנגנון הפישור על התוצאה. בכך הוא מצטרף לספרות הקיימת ותורם לדיון הציבורי על דרכים חלופיות ליישוב סכסוכים בכלל ועל השימוש בהן בבתי הדין לעבודה בפרט. פרק ב מציג את המסגרת לניהול הליכי פישור בבית הדין לעבודה ואת השערות המחקר מתוך עיון בספרות הרלוונטית. השערותינו העיקריות היו שייצוג של שני הצדדים מפחית את הסתברות הפשרה, שכאשר רק אחד מן הצדדים מיוצג תיטה תוצאת ההליך לטובתו (כשהמדד לכך הוא היחס בין הסכום שמקבל התובע לבין הסכום שנתבע), ושכאשר לעורך הדין המייצג את אחד הצדדים בהליך פישור יש מומחיות בהליכים מסוג זה הסתברות הפשרה תגדל, ותוצאת הליך הפישור תיטה לטובת לקוחו.פרק ג מתאר את שיטת המחקר. מאגר הנתונים מתבסס על כשלוש מאות תיקי דיון מהיר שבהם תבע עובד את מעבידתו. לגבי כל תיק נבדקו מאפייני הייצוג של הצדדים (ייצוג עצמי, ייצוג בידי עורך דין שאינו מתמחה בדיני עבודה, או ייצוג בידי עורך דין המתמחה בתחום), לצד נתונים נוספים כמו אופן סיום ההליך (פישור, פסק דין בדרך של פשרה או הכרעה שיפוטית רגילה) והסכום בו זכה התובע (בהשוואה לסכום התביעה). הנתונים שנאספו מאפשרים השוואה בין התוצאות בהתאם למאפייני הייצוג. פרק ד מציג את תוצאות המחקר. הממצאים הבולטים והמעניינים ביותר הם שייצוג מגדיל את הסתברות הצלחתם של הליכי הפישור; שייצוג הנתבעת מקטין את היחס בין הסכום שהתקבל לסכום שנתבע ("שיעור הפשרה"), אך גם ייצוג התובע מקטין את שיעור הפשרה; שהסתברות הצלחתו של הליך פישור היא כמעט 100% כאשר שני הצדדים מיוצגים על ידי שחקנים חוזרים, ושכאשר התובע מיוצג – שיעור הפשרה גבוה יותר אם הנציג הוא שחקן חוזר. בנוסף לכך מצאנו, מבלי שהייתה לנו השערה בנדון, כי בהליך הפישור שיעור הסכום שמקבל התובע מתוך הסכום הנתבע קטן בהשוואה למקרים של פסק דין על דרך הפשרה בבית הדין, ועוד יותר מכך, בהשוואה להליכים רגילים בפני בית הדין.פרק ה מנתח את הממצאים ומנסה להסבירם. את השפעתו החיובית של הייצוג על הסתברות הפשרה ניתן, למשל, להסביר באופיו המיוחד של ההליך שנבחן. בשל סכומי התביעה הנמוכים עורכי דין עשויים להעדיף סיום מהיר של ההליך, שכן שכר הטרחה מניהול הליך שיפוטי לא צפוי להיות גבוה במיוחד. בנוסף, עורכי דין יכולים להעריך טוב יותר את הסיכויים והסיכונים שבניהול הליך ולהעריך לאור זאת איזו פשרה תשפר את מצב הלקוח. כמו כן, עורכי הדין יכולים לצמצם את הטעויות וההטיות הקוגניטיביות של הלקוחות ובכך לסייע להצלחת הליכי הפישור. הממצא לפיו ככל שההליך פורמאלי יותר ומבוסס פחות על פשרה, התגמול לו זוכה התובע גדל, מאשש את אחת הטענות המרכזיות של המתנגדים להליכים חלופיים ליישוב סכסוכים שהליכים אלו מנוצלים לחיזוק כוחו של הצד החזק והחלשתו של החלש.פרק ו מסכם את עיקרי הממצאים והמסקנות, ומציע נקודות למחשבה על ההשלכות הנורמטיביות וכיוונים למחקר עתידי.
English Abstract: In recent years, recognition of the importance of alternative dispute resolution (ADR) in Israel has been growing, especially in areas in which the typical conflict arises between parties involved in a multifaceted long-term relationship that outlives the conflict itself, as is the case in employment and family disputes. Facilitative mediation and evaluative mediation have been an integral part of the employment tribunals' routine for many years, and their relative share in the resolution of legal disputes is still on the rise. Our article focuses on the impact of representation on the outcomes of evaluative mediation in the Israeli employment tribunals system, and on this method's effect on the outcome. It thereby contributes to the growing literature and public debate on ADR methods in general, and their use within the employment tribunals system in particular.Part Il presents evaluative mediation in the employment tribunals system – the subject matter of our study – and puts forward our hypotheses in light of the relevant theoretical and empirical literature. Our primary hypotheses are: (1) representation of both parties reduces the probability of success (agreed compromise); (2) when only one party is represented the outcome is more favorable to that party (as measured by the ratio between the amount received by the plaintiff and the amount claimed); and (3) when a party is represented by a repeat player in the employment tribunals system, the probability of success rises, and the outcome is more favorable to the repeat player's client.Part III explains the research design. Our dataset is based on more than 300 cases that qualified for a "fast track" procedure in the employment tribunals system (namely straightforward cases not exceeding NIS 25,000). In all the cases the plaintiff was an employee and the defendant was an employer. The data collected with regard to each case included information about the representation of each party (self-representation, representation by a one-shot advocate, representation by a repeat player), the conclusion of the case (a successful evaluative mediation, settlement in court, judicial decision following full trial), the amount claimed, the amount received, etc. The data enabled us to compare the outcomes in various representation conditions. Part IV presents the results of our study. The most salient and interesting findings are: (1) representation increases the probability of success; (2) representation of the defendant reduces the ratio between the amount received and the amount claimed ("compromise ratio"), but representation of the plaintiff also reduces the compromise ratio; and (3) the probability of success is nearly 100 percent where both parties are represented by repeat players, and when plaintiff is represented, the compromise ratio is higher if the agent is a repeat player. Incidentally, and without having any a priori hypothesis on this matter, we found that the ratio between the amount received and the amount claimed in a successful evaluative mediation (45 percent) is lower than in the case of a judge- assisted settlement (56 percent), and much lower than in the case of judgment following full trial (84 percent).Part V discusses the results. For instance, the positive effect of representation on the probability of success may be attributed to the unique characteristics of the evaluative mediation. The very low amounts claimed may induce lawyers to push for a quick conclusion of the case, because the additional effort associated with litigation may outweigh the marginal fee. Moreover, lawyers may better assess the chances and risks of litigation and determine whether accepting the proposed compromise is fair and preferable to the alternatives. Lawyers can also reduce the of impact of clients' mistakes and cognitive biases, thereby facilitating the success of the evaluative mediation. The finding that a more formal procedure, based more on judgment than on settlement, yields a better outcome for the plaintiff may corroborate ADR- opponents' intuition that ADR amplifies the power imbalance between the parties in unbalanced relationships.Part VI summarizes the findings and the conclusions, discusses normative implications, and proposes directions for further research.
