Abstract

The paper deals with the problem of analyzing the process of legal regulation in the energy sector in Europeran Union and Russia. EU and Russia actively pursue the policy of unifying of legal regulation in the energy sector to create national competitive markets and integrate them into the unified European energy system. In 2003, EU directives on energy supply (2003/54/EU) and gas supply (2003/55/EU) were adopted. These directives allow creating the common format of the liberalization of relevant markets for the 25 EU member states. In 2007, the new package of amendments and changes to the EU directives on electricity and gas was published. The general meaning of the amendments is to strengthen the requirements for the quality of competition on the European electricity and gas markets. The press release of the European Commission notes that the projects are designed to guarantee free access of consumers to gas and electricity markets and prohibit simultaneous control over the production and extraction of gas (electric power) and their transportation. The current EU directives on gas and electricity, adopted in 2003, require only separate transportation and production between different legal entities, but they can be part of the integrated company. We made the conclusion that if new EU directives on gas and electricity will be adopted, the largest European energy companies such as the German E.ON and the French EDF will be fragmented, and for Russian Gazprom, the path to expansion in Europe markets will be closed.
