A Infidelidade Partidária Como Causa Da Debilidade Da Cidadania No Brasil (The Absence of Political Party Loyalty As the Cause of the Weakening of Citizenship in Brazil)

Abstract

Portuguese Abstract: O objetivo do artigo é o de mostrar que a infidelidade partidária no Brasil acaba por soçobrar a cidadania e, em última instância, os direitos humanos no sistema político-jurídico brasileiro, visto que o fato contribui para o surgimento de verdadeiro déficit de representação do cidadão junto ao Estado. Para atingir este objetivo o artigo se divide em três seções principais. Na primeira é apresentada a legislação brasileira referente ao tema, apresentando-se tanto os aspectos constitucionais quanto infraconstitucionais do sistema partidário e de representação política do cidadão. Em seguida, a segunda parte traz a realidade prática do sistema político-partidário brasileiro, apresentando-se ao leitor as práticas político-partidárias desenvolvidas pelos parlamentares brasileiros que acabam por contribuir para com a falta de representação do cidadão. Por fim, a terceira parte apresenta uma possível solução para o problema, qual seja, a de implantação do sistema de lista fechada, por um lado, e do estabelecimento de critérios fundados no dever fundamental de participação política por parte do cidadão, por outro. A metodologia utilizada no artigo é primordialmente bibliográfica, complementada por informações estatísticas referentes aos partidos políticos e à participação política do cidadão brasileiro em geral.

English Abstract: The objective of this article is to show that political party loyalty in Brazil ends up weakening citizenship and, ultimately, human rights in the Brazilian political-legal system, since the fact contributes to the emergence of a true deficit in citizen representation within the State. To achieve this goal the article is divided into three main sections. The first presents the Brazilian legislation on the subject, presenting both constitutional and infra-constitutional aspects of the political party system and political citizen representation. The second part brings the reality of the Brazilian political party system, presenting the reader the political party practices developed by Brazilian parliamentarians which end up contributing towards the lack of citizen representation. Finally, the third part presents a possible solution to the problem, namely the implementation of the closed list system, on the one hand, and the establishment of criteria based on the fundamental duty of political participation by the citizen on the other. The methodology used in the article is primarily literature, complemented by statistical information relating to political parties and political participation of Brazilian citizens in general.
