Abstract

The authors discuss the far reaching implications arising from Hua Tian Long (No 3) relating to the common law doctrine of Crown immunity and questions whether the right to immunity can be transferred to the Central People’s Government and its instrumentalities when China resumed sovereignty in 1997.
