Abstract

Spanish Abstract: El presente trabajo aborda la forma mediante la cual el Ius Constitutionale Commune en América Latina (ICCAL), que supone un cambio fundamental en la forma de pensar el derecho público en la región, puede relacionarse con el Derecho Internacional de Inversiones (DII). En este sentido, se exponen tres escenarios posibles de interacción: La restauración de la autoridad absoluta del Estado, re-orientación externa en la arena internacional y reformas dentro del régimen de inversiones para legitimar su autoridad. Se argumenta que de estos escenarios el tercero puede favorecer la relación entre el DII y el ICCAL, siempre y cuando se pueda unificar un discurso jurídico regional en base a principios jurídicos comunes que puedan interactuar dentro del DII. De esta forma se puede evitar el que la autoridad ejercida por árbitros de inversiones termine menoscabando los objetivos fundamentales de ICCAL en la región.

English Abstract: This paper addresses the way in which Ius Constitutionale Commune in Latin America (ICCAL) that represents a fundamental change in the way of thinking about public law in the region can interact with the International Investment Law (DII) regime. In this sense, three possible scenarios of interaction are analyzed: the restoration of an absolute authority of the State, external re-orientation in the international arena and reforms within the investment regime to legitimize its authority. I argue here that from these scenarios the third can produce a productive interaction between the DII and the ICCAL, as long as a regional legal discourse based on common legal principles can be formed. In this way, it can also be avoided that the authority exercised by investment arbitrators ends up undermining the fundamental objectives of ICCAL in the region.
