Abstract

Spanish Abstract: Asumimos la intención de desarrollar un ensayo que nos permita explorar nuevos caminos para áreas menos exploradas de Derecho Administrativo. En ese sentido, queríamos que el tema de nuestra investigación tuviera la capacidad de señalar la importancia de la organización administrativa como un requisito previo esencial, a menudo ignorado, de la actividad de la administración pública. Pero también, sentimos la necesidad de asumir nuestras limitaciones en el campo complejo del conocimiento científico que van más allá de nuestra capacitación específica y buscar la adquisición de tales enseñanzas para una mejor comprensión de los problemas que requieren un enfoque multidisciplinario. Teniendo en cuenta esos objetivos primordiales, decidimos dedicar nuestra tesis al Mecanismo Único de Supervisión, una empresa que comienza la construcción de una Unión Bancaria en la UE, que se ve sumida en una crisis económica y financiera y enfrenta el riesgo de desintegración de la zona del euro. y la salida del Reino Unido de esa organización supranacional. Este es un tema que se encuentra dentro del Derecho Administrativo Bancario, que no está suficientemente explicado por la doctrina del derecho público y generalmente se expone brevemente en documentos y libros sobre el Derecho Privado Bancario. Por otro lado, es un ejemplo particularmente ilustrativo de que las conclusiones extraídas de un análisis estrictamente limitado a la perspectiva de un área de conocimiento pueden ser engañosas, porque eso implica inevitablemente el dominio de conceptos, comprensión e interpretación de fenómenos y la aplicación de los conocimientos que se nos ofrecen las ciencias económicas, financieras y de la contabilidad. Por estos motivos, pretendemos desarrollar un estudio sobre los cambios más recientes en el marco regulatorio que rige la intervención pública en el sistema bancario para evitar la repetición de escándalos financieros sucesivos marcados por fallas de supervisión, especialmente exaltando la importancia de la arquitectura institucional, particularmente la creación casuística de agencias reguladoras, y el progreso de la jurisprudencia pretoriana del TJCE. Todo esto en un período de importantes transferencias de poderes de los Estados miembros a una Unión Europea que carece de una teoría general del procedimiento administrativo europeo. Respetando el enfoque de esta tesis, trataremos de aludir a los otros pilares que conforman el proyecto de la Unión Bancaria, a saber, el mecanismo único de resolución y el sistema europeo de garantía de depósitos, en vista de la complementariedad funcional mutua que se mantiene con el Sistema Europeo de Supervisión. Asimismo, realizaremos algunas consideraciones sobre el llamado "caso BES", prestando atención a la inevitable pregunta relativa a la calificación de "fit and proper" de los miembros del órgano de administración de ese banco con importancia sistémica.

English Abstract: We assume the intention to develop an essay that would allow us to explore new paths for less explored areas of Administrative Law. In that sense, we wanted that the subject of our investigation had the ability to point out the importance of administrative organization as an essential prerequisite - often overlooked - of the activity of public administration. But also, we feel the need to assume our limitations in the field of complex scientific knowledge that go beyond our specific training and seek the acquisition of such teachings to a better understanding of issues that require a multidisciplinary approach. Considering those primary objectives, we decided to dedicate our thesis to the Single Supervisory Mechanism, an enterprise that begins the construction of a Banking Union in the EU, which is plunged into economic and financial crisis and faced with the risk of disintegration of the Euro area and the exit from the UK that supranational organization. This is an issue that falls within the Administrative Banking Law, insufficiently explained by the public law doctrine and usually exposed briefly by papers and books about Banking Private Law. On the other hand, it is a particularly illustrative example of the conclusions drawn from an analysis strictly limited to the perspective of an area of knowledge can be misleading, because that inevitably involves mastery of concepts, understanding and interpretation of phenomena and the application knowledge that are offered by Economics, Finance and Accounting Sciences. For these reasons, we intend to develop a study on the most recent changes to the regulatory framework governing public intervention in the banking system to prevent the repetition of successive financial scandals marked by supervisory failures, especially extolling the importance of institutional architecture - particularly the case-by-case creation of regulatory agencies - and the progress of the praetorian jurisprudence of the ECJ. All of this in a period of significant transfer of powers from Member States to a European Union that is devoid of a general theory of European administrative procedure. Respecting the focus of this thesis, we will try to allude to the other pillars that make up the Banking Union project, namely the single resolution mechanism and the European system of deposit guarantee, in view of the mutual functional complementarily that keep with the European supervisory system. Likewise, we will produce some considerations about the so-called “BES case”, paying attention to the inevitable question concerning the fit and proper assessment of management body members of that bank with systemic importance.
