European Council’s Amended Proposal for a Directive on Copyright in the Digital Single Market; Is It Enough to Ward Off the Threat to Press Freedom?

Abstract

Much has been said already about article 13 of the proposed new European Directive on copyright in the Digital Single Market. However, the issue of press freedom has hardly been featured in this, sometime heated, debate. That is disadvantageous while the modern professional media in Europe rely more and more on social platforms to disseminate its news-stories. The exploitation of that new and increasingly significant publication-channel might be hampered by automated filtering measures, as article 13 of the proposed new Directive under certain circumstances requires. This article analyses the role of social media for professional journalism in the current digital age, the effect the proposed new Directive might have on it, the latest adjustments the European Council has suggested and explores the possibility of alternative solutions.
