Abstract
English Abstract: Recent years have brought developments in international law with direct bearing on the bio-based economy. The primary development has been the entry into force of the Nagoya Protocol on Access and Benefit Sharing to the Convention on Biological Diversity. Other relevant developments have occurred at the World Intellectual Property Organisation (WIPO), the United Nations Educational, Scientific and Cultural Organisation (UNESCO) and Canada’s adoption of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). This article surveys the various developments, and posits that changes in Canada’s approach to genetic resources and traditional knowledge may evolve given changes in Government policy towards Indigenous Peoples.
