El constitucionalismo interamericano y la fragmentación del derecho internacional: posicionando al ICCAL en el debate sobre colisiones entre regímenes normativos (Inter-American Constitutionalism and Fragmentation of International Law: Situating ICCAL in the Debate on Regime Collisions)

Spanish Abstract: La actividad de las empresas transnacionales es protegida ante todo por el derecho económico internacional (DEI), un régimen normativo que carece de regulaciones específicas para lidiar con afectaciones a la democracia y graves violaciones de derechos humanos producidas por estas actividades, y que de hecho en casos concretos puede entrar en colisión con el derecho internacional de los derechos humanos (DIDH). En este artículo se plantean algunas soluciones a esta problemática a la luz del ius constitutionale commune en América Latina (ICCAL). Para ello se hace una breve introducción al debate sobre fragmentación del derecho internacional y colisiones entre regímenes normativos (especialmente entre DEI y DIDH); posteriormente se ubica al ICCAL en el conjunto de teorías jurídicas sobre esta temática; y finalmente se ofrecen algunas alternativas en casos de colisiones normativas, diferenciando entre ámbitos del ius cogens (u otros estándares fundamentales del DIDH, en los que se impone la prevalencia del DIDH), y colisiones en ámbitos de potencial cooperación entre DEI y DIDH. La tesis central que se defiende aquí es que si América Latina avanzara hacia la consolidación de un ius constitutionale commune que tuviera en cuenta la diversidad de actores involucrados en violaciones de derechos humanos, sería posible oponer estos estándares regionales a empresas o Estados cuyas acciones u omisiones sean contrarias a tales estándares, y en determinados casos incluso procesarlos ante la Corte Interamericana de Derechos Humanos.

English Abstract: The activities of transnational companies are, first and foremost, protected by International Economic Law (IEL). This legal regime lacks specific devices to tackle adverse impacts on democracy and serious violations of human rights originating from such activities, and thus, in certain cases, conflicts with international human rights law (IHRL) can emerge. This paper proposes some solutions for this problématique in light of the ius constitutionale commune en América Latina (ICCAL). In a first step, the paper introduces the debate on the fragmentation of international law and collisions of legal regimes (especially between IEL and IHRL). Subsequently, ICCAL is located within the body of relevant legal theories relevant to the subject matter at hand. Finally, the paper offers some options to deal with regime collisions, thereby differentiating between issues pertaining to ius cogens (or other fundamental IHRL standards, in which case IHRL should prevail) and collisions in areas of potential cooperation between IEL and IHRL. At its core, the paper argues in favour of consolidating a ius constitutionale commune in Latin America which takes into account the diversity of the actors involved in the relevant human rights violations. This would allow to invoke such regional standards when companies violate them through actions or omissions and, in certain cases, even to hold these companies accountable before the Inter-American Court of Human Rights.
