Uitzonderingen in rookverboden: uitzonderlijke missers? Een rechtssociologisch onderzoek naar de werking van uitzonderingen op het rookverbod in de horeca. (Partial Smoking Bans: A Big Failure?: A Study Into the Working of Partial Smoking Bans in the Dutch Hospitality Industry)

Abstract

Dutch Abstract: Er is veel discussie over het aanhouden of afschaffen van rookruimtes in het kader van het rookverbod in de Nederlandse horeca. Rookverboden worden ingevoerd om de gezondheid van in dit geval horecamedewerkers en -bezoekers te beschermen, door te voorkomen dat zij worden blootgesteld aan tabaksrook. Het is onduidelijk hoe uitzonderingen als rookruimtes bijdragen of juist afbreuk doen aan het doel van een rookverbod. In dit rechtssociologische onderzoek is vanuit het perspectief van horecaondernemers naar de werking van twee uitzonderingen gekeken: rookruimtes en kleine cafés zonder personeel. De resultaten, gebaseerd op enquêteresultaten en interviews, laten zien dat er in de praktijk talrijke nadelen kunnen kleven aan uitzonderingen op rookverboden en dat het weinig aannemelijk is dat het huidige rookverbod in de horeca medewerkers optimaal beschermt tegen de schadelijke gevolgen van meeroken.

English Abstract: There is currently much discussion about whether to abolish or maintain segrated smoking rooms in the Dutch hospitality industry. The smoking bans are aimed at protecting bar employees and customers from the dangers of second-hand smoke. However, it is not clear whether exemptions such as segregated smoking rooms contribute to or harm these health protection goals. This socio-legal study investigates smoking bans from the perspective of hospitality workers. Two excemptions have been studied: segrated smoking rooms and the exemption for small bars without employees. The results, which are based on survey data and semi-structered interviews, show that there are several disadvantages related to exemptions. Thus, it is implausible that a smoking ban that allows for exemptions will be effective in protecting customers and employees from the dangers of second-hand smoke.
