Spanish Abstract: Hace cinco años, cuando México transformó su sector energético, la mayoría de los analistas estaban preocupados con respecto a la capacidad del gobierno para implementar la reforma. ¿Cómo serían los contratos de la fase aguas arriba? ¿Serían transparentes las subastas? ¿Cómo reaccionarían las compañías internacionales? Después de dos rondas de subasta exitosas, 107 contratos firmados y la creación de agencias reguladoras viables para gestionar y supervisar la agenda de la reforma, las preguntas han cambiado. Hoy en día, la capacidad de México para implementar las reformas energéticas y atraer inversión extranjera ya no está en duda. Ahora, las preguntas más importantes sobre la reforma se refieren a su sostenibilidad a largo plazo. ¿Puede sobrevivir a los ciclos electorales de México? ¿Continuará México por el mismo camino que fomenta la participación privada en el desarrollo de nuevos campos? ¿Qué tan seguras están las inversiones actuales en México luego del surgimiento del populismo y el nacionalismo en la narrativa política mexicana? En otras palabras, con miras al futuro, ¿son los cimientos de los pilares legales necesarios lo suficientemente firmes para resistir cualquier huracán político?

Este capítulo no puede abordar completamente todos los sectores cubiertos por la reforma; más bien, se centrará en por qué la arquitectura legal de la reforma energética para actividades de la fase aguas arriba no es tan “a prueba de balas” e “irreversible” como afirman algunos funcionarios mexicanos.

English Abstract: Five years ago, when Mexico transformed its energy sector, most analysts were concerned about the government's ability to implement the reform. What would the contracts be like in the upstream phase? Would the auctions be transparent? How would international companies react? After two successful auction rounds, 107 signed contracts and the creation of viable regulatory agencies to manage and oversee the reform agenda, the questions have changed. Today, Mexico's ability to implement energy reforms and attract foreign investment is no longer in doubt. Now, the most important questions about the reform relate to its long-term sustainability. Can it survive the electoral cycles of Mexico? Will Mexico continue on the same path that encourages private participation in the development of new fields? How safe are the current investments in Mexico after the emergence of populism and nationalism in the Mexican political narrative? In other words, with a view to the future, are the foundations of the necessary legal pillars firm enough to withstand any political hurricane?

This chapter can not fully address all sectors covered by the reform; rather, it will focus on why the legal architecture of the energy reform for activities in the upstream phase is not as "bulletproof" and "irreversible" as some Mexican officials claim.
