Abstract

Deutsche Zusammenfassung: Die Frage, wie das Zivilrecht auf Verstöße gegen gesetzliche Verbote reagieren soll, quälte und quält Richter und Rechtswissenschaftler dies- und jenseits des Ärmelkanals. Mit Patel v Mirza hat der Supreme Court des Vereinigten Königreichs das englische Recht der illegality einer Kernsanierung unterzogen und dabei, wie häufig bei solchen Renovierungen, vom ursprünglichen Gebäude kaum etwas stehen gelassen.

In dieser Entscheidungsbesprechung wird zunächst die geschichtliche Entwicklung der illegality-Doktrin im englischen Recht skizziert (unter 2.), um sodann die Entscheidung des Supreme Court darzustellen (unter 3.). In den folgenden beiden Abschnitten wird das deutsche Recht dargestellt (unter 4.) und die Lösung des Supreme Court im Vergleich dazu kritisch gewürdigt (unter 5.).

English Abstract: The question of how civil law should respond to violations of legal prohibitions has and continues to torment judges and scholars on both sides of the English Channel. With the case of Patel v. Mirza, the Supreme Court of the United Kingdom has fundamentally revised the English law of illegality and in the process, as often occurs in such a revamping, has left hardly any of the original structure intact.

This case note first describes the historical development of the illegality doctrine in English law before then presenting the ruling of the Supreme Court. Subsequently, German law is outlined and the resolution of the Supreme Court is comparatively assessed.
