Abstract

Indonesian Abstract: Sebagai sebuah negara hukum yang demokratis, negara Indonesia wajib untuk melindungi dan menghormati HAM setiap orang sebab HAM tidak hanya merupakan hak kodrat namun juga merupakan hak konstitusional rakyat yang dijamin dalam UUD NRI Tahun 1945. Rekonstruksi Hukum HAM di Indonesia perlu segera dilakukan sebagai wujud komitmen Indonesia dalam berbagai ratifikasi Instrumen HAM Internasional khususnya perlindungan hak KBB. Indonesia hendaknya dalam menempatkan pola relasi antara agama dan negara yang konstitusional dengan meneguhkan diri pada konsep negara hukum yang demokratis dan berbasis Pancasila dengan tetap menghormati prinsip-prinsip dasar perlindungan hak KBB sebagaimana diatur dalam Pasal 18 Kovenan Sipol dan Komentar Umum 22 serta Deklarasi 1981. Optimalisasi Rencana Aksi Nasional HAM (RANHAM) 2015-2019 adalah sebuah keniscayaan untuk mendorong percepatan harmonisasi norma HAM Internasional ke dalam hukum nasional dan menjamin penegakan pelanggaran hak KBB yang sesuai dengan norma dan standar HAM Internasional.

English Abstract: As a democratic legal state, the Indonesian state is obliged to protect and respect human rights for every person because human rights are not only natural rights but also constitutional rights of the people guaranteed in the 1945 Constitution of the Republic of Indonesia. Human Rights Law Reconstruction in Indonesia needs to be done as a manifestation of Indonesia's commitment to various ratification of International Human Rights Instruments specifically the protection of KBB rights. Indonesia should place a pattern of relations between religion and the state constitutionally by affirming itself to the concept of a democratic and Pancasila-based legal state while respecting the basic principles of the protection of FoRB as stipulated in Article 18 of the Civil Covenant and General Comment 22 and Declaration of 1981. Declaration The 2015-2019 National Human Rights Action Plan (RANHAM) is a necessity to encourage the acceleration of the harmonization of international human rights norms in national law and ensure the enforcement of violations of KBB rights in accordance with international human rights norms and standards.
