Abstract

District of Columbia v. Heller marked the first unequivocal recognition of the Second Amendment as as individual right. This paper analyses the principal dissent to that finding, submitted by Justice Stevens and joined by the three other dissenters. It concludes that the dissent was in error and would have had disastrous results for the Court's public credibility had it become law.
