תקציר בעברית: מידת האפקטיביות של רגולציה תלויה במבנה התמריצים של הרגולטורים, ומבנה התמריצים של רגולטורים מושפע משיקולי קריירה ובפרט מהאפשרות להיות מועסקים בעתיד על ידי הגופים שהם מפקחים עליהם בהווה. מעברים תכופים בין מפקחים למפוקחים – תופעת ה"דלתות המסתובבות" – עלולים לפגוע באפקטיביות של הרגולציה. הפתרון שאומץ בישראל הוא תקופת צינון. אך האם תקופת הצינון הקבועה בחוק אכן נאכפת בפועל? האם היא יכולה להשיג את מטרותיה המוצהרות? מאמר זה בוחן את האפקטיביות של תקופת הצינון בשיטות מגוּונות: מחקר השוואתי, קידוד כל ההחלטות של ועדת ההיתרים המוסמכת בחוק לקצר את הצינון וראיונות עם אלה המופקדים על אכיפתה של תקופת הצינון ואלה הכפופים לה. המאמר מתעד פער ניכר בין תקופת הצינון החקוקה לבין תקופת הצינון בפועל, ומסביר כיצד הפער נוצר – מהן הקונסטרוקציות המשפטיות המכשירות אותו ומהם ההסברים ההתנהגותיים שבבסיסו. לבסוף, המאמר מעריך את רציותם של פתרונות אפשריים לבעיית הדלתות המסתובבות: בעוד הצעות להאריך את תקופת הצינון החקוקה מוּעדות לכישלון, הצעות להעניק גמול מסוים לרגולטורים במהלך תקופת הצינון עשויות להצליח.

English Abstract: The revolving doors between the public and private sectors may reduce the effectiveness of regulation. To combat the potential harms of the revolving doors, Israel, like many other developed countries, adopted cooling-off periods. Yet we know very little about how effective cooling-off periods are. This paper triangulates different methods – from comparative- to content analysis to interviews with those in charge of cooling-off enforcement – and concludes that cooling-off periods as currently construed are highly ineffective. The paper documents the significant gap between the cooling-off periods on the books and cooling-off periods in action; explains how this gap is formed; and sketches ways to mitigate the gap and improve the regulation of revolving doors.
