Abstract
In this essay, I examine the significance of the new federalism doctrine, analyze the legal opinions in Hibbs, and offer commentary on the revised history of protective legislation, the state of equal protection analysis for gender-based discrimination, and some worrying potential limitations to Congress’s ability to expand the FMLA.
