Abstract
The last 30 years have seen the emergence of the 'hero judge' in Australia. It will be argued that these judges have emancipated themselves, as they see it, from the straitjacket of law as authority, and see law, instead, as a matter of technique to enable judges to develop the law to suit the needs of the managerialist state.
