Abstract

Portuguese Abstract: Este artigo objetiva examinar a tributação federal sobre as subvenções estatais, mas se desvinculando da tradicional análise feita a partir da ótica e dos interesses do Ente Subvencionador como critério de classificação da subvenção entre as espécies “para custeio” (tributada) e “para investimento” (não tributada). Propõe-se que a classificação da subvenção nessas espécies, para fins fiscais, seja repensada a partir da ótica da Entidade Subvencionada e, especialmente, da destinação dada por ela ao resultado/benefício daquela subvenção. Nesse contexto, as condições estabelecidas no art. 30 da Lei nº 12.973/2014 revelam-se como critérios objetivos de demonstração da intenção de capitalização da empresa pela entidade subvencionada e do consequente direito ao benefício fiscal de exclusão da base de cálculo dos tributos federais. Ressalte-se que, por caminho diverso e censurável, a Lei Complementar nº 160/2017 chegou ao mesmo resultado, o que levará provavelmente a uma mudança do objeto do contencioso tributário relacionado ao assunto, que passará a se centrar na contabilização dos valores pela sociedade, salvo se prevalecer o “cheque em branco” concedido pelo Superior Tribunal de Justiça - STJ, no julgamento dos Embargos de Divergência em Recurso Especial - EDv em REsp nº 1.517.492/PR, com base na possível quebra do pacto federativo decorrente da tributação pela União Federal dos incentivos concedidos pelos Estados, decisão final esta que caberá ao Supremo Tribunal Federal.

English Abstract: This paper aims to examine the federal taxation on state subsidies, but dissociating itself from the traditional analysis made from the perspective and interests of the Subsider Entity as a criterion for classifying the subsidy between the species "for costing" (taxed) and "for investment" (not taxed). It is proposed that the classification of the subsidy in these species, for fiscal purposes, be rethought from the perspective of the Subsidized Entity and, especially, the destination given by it to the result/benefit of that subsidy. In this context, the conditions established in art. 30 of Law No. 12,973/2014 are objective criteria for demonstrating the company's intention to capitalize the subsidized entity and the consequent right to the tax benefit of excluding the basis of calculation of federal taxes. It should be noted that Complementary Law no. 160/2017 reached the same result in a different and reprehensible way, which will probably lead to a change in the subject of tax litigation related to the matter, which will focus on the accounting of amounts by society, unless the "blank check" granted by the Superior Court of Justice (STJ), in the judgment of the EDv in REsp nº 1,517,492 / PR, based on the possible breach of the federative agreement resulting from the taxation by the Federal Union of incentives granted by the States, a final decision that will be the responsibility of the Federal Supreme Court.
