Abstract

תקציר בעברית: בשנים האחרונות מתמודדת שיטת המשפט הישראלית עם החובה לספק תנאי מאסר ומעצר נאותים לשוהים בבתי הסוהר ובבתי המעצר. המציאות היא שקיים פער בלתי ראוי בין תנאי כליאה שיוכלו להיחשב הולמים לבין אלה הנוהגים בפועל. תופעה זו משקפת "כשל שוק" דמוקרטי. תנאי כליאה הולמים טעונים משאבים הולמים, וקל להימנע מהשקעתם באופן מתמשך שכן קבוצת העצורים והאסירים נטולה כוח פוליטי של ממש.

המאמר ממקד את המבט בנגזרת חשובה של הסוגיה והיא תנאי המעצר של עצורים בהשוואה לאסירים. להבחנה זו משמעות נורמטיבית ומעשית כפולה: ראשית, במקרים המתאימים יש להעניק לעצורים תנאי מעצר טובים יותר מאלה של האסירים, כאשר מתקיים שוני רלוונטי בין אלה לאלה, בהינתן חזקת החפות העומדת לימינם; שנית, ודאי שאין מקום ליתן לעצורים יחס רע יותר מאלה שזוכים לו האסירים. לגישה הנורמטיבית הזו יש הד ברור במשפט הבינלאומי הפומבי. היא מעוגנת בסעיף 10(2) לאמנה בדבר זכויות אזרחיות ומדיניות משנת 1966, שישראל אשררה. אלא שהמציאות הנוהגת בישראל מלמדת כי הנורמות הנובעות מההבחנה על שני מובניה מופרות באופן רחב: במקרה הטוב נוהגת גישה המאחדת שלא כדין בין תנאי הכליאה של האסורים ושל העצורים, ובמקרים רבים תנאיהם של העצורים גרועים יותר מאלה של האסירים. על רקע זה גדלה חשיבותה של ביקורת שיפוטית אפקטיבית הבאה לשמור על מימוש הנורמה הלכה למעשה. אגב מימוש הביקורת השיפוטית יכולה להיות משמעות לנורמה הבינלאומית. הדין המקומי יכול להיות מפורש באופן העולה בקנה אחד עמה, ותוך קידומה. הנורמה הבינלאומית יכולה לשמש גם מקור חשוב של לגיטימציה לאמות המידה שקובעים בתי המשפט אגב הפעלת הביקורת השיפוטית, המחייבות הקצאת משאבי ניכרים לשיפור תנאי המעצר.

המאמר יבחן את הדברים במישור העיוני ובמישור המעשי, ויציג גם דוגמאות קונקרטיות בהן הביקורת השיפוטית יכולה לתרום לצמצום הפער בין המתחייב לבין המציאות הנוהגת במתקני המעצר שלנו.

English Abstract: In recent years, the Israeli legal system has been dealing with the obligation to provide appropriate prison and detention conditions to those imprisoned and detained. An inadequate gap exists between the appropriate conditions of imprisonment and those that actually practiced. This phenomenon reflects a democratic "market failure". Appropriate conditions of incarceration require adequate resources, and it is easy to continuously avoid their investment, as the group of detainees and prisoners lacks real political power.

The article focuses on the detention conditions of detainees as compared to those of prisoners. This distinction has a dual normative and practical significance: first, in appropriate cases, detainees should be given better conditions of detention than those of prisoners, where there is a relevant difference between the two groups, given the presumption of innocence which detainees enjoy; Second, there is certainly no reason to give the detainees any worse treatment than the prisoners. This normative approach has a clear echo in international public law. It is stipulated in Article 10 (2) of the International Convention on Civil and Political Rights of 1966, which Israel ratified. The prevailing reality in Israel shows a continuous breach of that norm: in the best case, the same attitude is being implemented towards prisoners and detainees alike, and in many cases the conditions of the detainees are worse than those of the prisoners. Against this background, the importance of effective judicial review, which is intended to preserve the realization of the norm in practice, has grown. While implementing judicial review the Israeli courts can refer to the international norm: Local law can be interpreted in a manner consistent with it. In addition, the international norm can serve as an important source of legitimacy for the standards established by the courts which will resort in a demand to allocate more resources in order to improve the detainees conditions.

The article will examine the theoretical and practical aspects of this topic, and will also present concrete examples in which judicial review can contribute to narrowing the gap between the normative obligation and the reality in our detention facilities.
