Abstract
This paper interrogates the frustration and difficulty that Kenya has faced in its attempt to implement gender quotas entrenched in the 2010 Constitution. The 2010 Constitution stipulates that not more than two thirds of any gender should occupy appointive and elective seats. However, this requirement has not been adhered to. The paper goes on to interrogate the jurisprudence that has emerged from Kenya's courts on the question of implementation of gender quotas.
