Abstract
Romanian Abstract: Trimiterile preliminare reprezintă o procedură prin care instanţele naţionale pot formula întrebări prin care să solicite Curţii de Justiţie a Uniunii Europene să interpreteze dreptul Uniunii Europene precum și să se pronunțe cu privire la validitatea și interpretarea actelor adoptate de instituțiile, organele, oficiile sau agențiile Uniunii (art. 267 TFUE). În același timp, trimiterile preliminare formulate de instanțele din România pun în lumină un accent nou cu privire la raportul dintre puterile și instituțiile statului. Prezentul articol încearcă să deceleze o parte din posibila deplasare a echilibrului puterilor, precum tensiunea judiciară în aplicarea și interpretarea dreptului.
English Abstract: Preliminary ruling is a procedure by which the national courts can ask the Court of Justice of the European Union to interpret the Union law and to rule on the validity and interpretation of the acts adopted by the Union institutions, bodies, offices or agencies (Article 267 TFEU). At the same time, the preliminary rulings sent by the Romanian courts highlight the relationship between the state’s powers and institutions. This article tries to present the possible movement in the balance of powers, such as judicial tension in the application and interpretation of law.
