Abstract
Spanish Abstract: El artículo estudia el contrato de compraventa en Hispanoamérica y Filipinas entre los siglos XVI y XVIII. El mismo consistía en que un vendedor y un comprador, al prestar su consentimiento, se obligaban, el primero a entregar una mercancía o merced, y el segundo a pagar un precio en dinero. Se analiza, por consiguiente, dónde y quiénes podían realizar este tipo acto, destacando la figura del comerciante como uno de los actores principales. Otra de las figuras de estudio será la relación entre los clérigos y la compraventa. Los elementos principales de este contrato en el derecho canónico fueron tres: el consentimiento, el precio y finalmente, qué se podía comprar y vender. Este estudio aborda también distintas disposiciones que podían ser agregadas al contrato y cómo se consumaba el acto. A lo largo de esta entrada se reconocerá la gran importancia de este contrato debido a que promovió el abastecimiento a los hispánicos asentados en las Indias y a las ventajas que le originó a España, tanto a la Corona como a los mercaderes propiamente dichos, sin soslayar la influencia canónica en las normas en el derecho castellano.
English Abstract: The article studies the purchase and sale contract in Hispanic America and the Philippines between the XVI and XVIII centuries. The contract consisted of a seller and a buyer that with their giving consent, were obligated, the first to deliver a merchandise, and the second to pay a price in money. Therefore, it is analyzed where and who could perform this type of act, highlighting the figure of the merchant as one of the main actors. Another study figure will be the relationship between the clergy and the sale. In canon law, the main elements of this type of contract were three: the consent, the price and finally, what could be bought and sold. This study also addresses different dispositions that could be added to the contract and how the act was consummated. Throughout this entry, it will be recognized the great importance of this contract because it promoted the supplying of goods to the Hispanic people in the Indies and the advantages that were originated in Spain, both to the Crown and the merchants themselves, without ignoring the canonical influence on the norms in the Spanish law.
