Abstract

German Abstract: Im aktuellen Fall um die Ministererlaubnis der beiden Mittelständler Miba und Zollern wurden von den antragstellenden Unternehmen bereits bekannte, aber auch neue Begründungen verwendet, um einen Gemeinwohlvorteil des antikompetitiven Zusammenschlusses aufzuzeigen. Wir untersuchen diese Gründe auf ihre wirtschaftstheoretische Fundierung und kommen zu dem Ergebnis, dass der Bundeswirtschaftsminister sich dem Votum der Monopolkommission anschließen und die Erlaubnis nicht erteilen sollte. Des Weiteren empfehlen wir eine grundsätzliche Überarbeitung des Instruments Ministererlaubnis, um ein Weiterbestehen rechtfertigen zu können.

English Abstract: In the current case concerning the ministerial approval of Miba and Zollern, the applicant companies used already known but also new justifications in order to demonstrate public interest advantages of the anti-competitive merger. We examine these reasons for their economic-theoretical foundation and conclude that the Federal Minister of Economics should join the vote of the Monopolies Commission and not grant permission. Furthermore, we recommend a fundamental revision of the instrument in order to be able to justify its continued existence.
