Abstract

תקציר בעברית: רשימה זו היא חלק מסימפוזיון על עבודתו ומחקריו של פרופ' מנחם מאוטנר. הרשימה עוסקת בשני נושאים מרכזיים: היחס בין פורמליזם משפטי לאקטיביזם שיפוטי והיחס בין כתיבה אקדמית לכתיבה שיפוטית. בנושא הראשון, נטען שפורמליזם ואקטיביזם אינם בהכרח סותרים זה את זה. כלומר, ניתן לדגול בגישה פורמליסטית ולהיות אקטיביסט או אנטי-אקטיביסט, כשם שניתן לדגול בגישה אנטי-פורמליסטית ולהיות אקטיביסט או אנטי-אקטיביסט. יש אפוא חשיבות להבחנה בין הפסיקה האופרטיבית של בית המשפט לבין הרטוריקה השיפוטית שבה משתמשים השופטים. בנושא השני, נטען שבצד מחקרים אקדמיים תיאורטיים, בינתחומיים וביקורתיים, יש חשיבות רבה גם למחקרים אקדמיים דוקטרינריים ולמחקרים המשלבים בין נקודות המבט השונות על המשפט ומתוכו. כמו כן, נטען שאין קשר הכרחי בין המתודולוגיה של הניתוח הכלכלי לבין האידאולוגיה הימנית של רבים מאלה העוסקים בניתוח כלכלי של המשפט. כלומר, ניתן להשתמש במתודולוגיה של הניתוח הכלכלי וליהנות מיתרונותיה הרבים, מבלי לדבוק בהנחה הפשטנית שכל האנשים הם ממקסמים רציונליים של תועלתם האישית ומבלי לאמץ השקפת-עולם אינדיבידואליסטית וקפיטליסטית.

English Abstract: This essay is part of a symposium on the work and research of Prof. Menachem Mautner. It deals with two primary issues: the relationship between legal formalism and judicial activism and the relationship between academic scholarship and judicial reasoning. Regarding the first issue, it is argued that formalism and activism are not incompatible. That is to say, a judge may endorse legal formalism and be either activist or anti-activist, just as he or she may reject legal formalism and be activist or anti-activist. Thus, it is important to note the distinction between the operative decisions courts make (which may be more or less activist) and the rhetoric they use (which may be more or less formalist). As for the second issue, it is argued that along with theoretical, interdisciplinary, and critical legal studies, doctrinal scholarship is very important; and that legal scholars should strive to integrate various external and internal perspectives on the law. It is further claimed that there is no necessary association between economic methodology and the right-wing ideology of many of those who engage in economic analysis of law. One may employ the methodology of economic analysis and enjoy its various advantages, without adopting the simplistic assumption that people are invariably rational maximizers of their self-interest and without adhering to an individualistic and capitalistic worldview.
