Abstract

How did the rebellious legalism of the American Revolution become the learned law tradition of the Early Republic? This essay seeks to answer this question by suggesting that the Early Republic's learned law jurisprudence is inextricably linked to the experience of the American Revolution. Before the Constitution's ink was dry... an elite of America's legal profession had embarked upon what I call the first republican revival.
