Abstract

Though the International Criminal Court (‘ICC’) is currently facing huge criticism, preliminary examinations of the ICC have become one of the most significant instruments of Court practice and have been acquiring growing importance for the last few years.3 However, in the context of sexual and gender-based crimes, it is disheartening that many allegations of rape and other forms of sexual violence against women do not make it beyond preliminary examination; hence the effective investigation and prosecution of such offences against women simply do not take place.
