Abstract

This article reviewed the current ex gratia compensation for miscarriage of justice and argued that it offered inadequate protection to victims of a miscarriage of justice. The procedure is cumbersome and arbitrary; it is particularly difficult to work when the miscarriage of justice was caused by the judiciary. It recommended that the ex gratia scheme should be replaced by a statutory scheme.
