Abstract
English Abstract: Since 1960, the Environmental Law in the Republic of Congo has, as a matter of fact, broad-based legal basis. The latter, which have although been formulated under the influence of the legislation of May 21, 1962, have been overlapping prior to being crystallized by the Environmental Act of April 23, 1991. On the face of the whole rule, the Environmental Law is indeed designed and has hardened with equivocation or randomness, termed ‘ambivalence’ in this paper. This equivocation is reflected between the Constitution, which enhances the level of the environmental protection and enshrines the right of citizens to a clean and healthy environment, and the Environmental Act, which has nowadays lost the normative consistency intended by the legislator in 1991. In addition, this ambivalence takes the form of the difficult adjustment of the legislation to environmental challenges, the scattering of norms and competences, the dull and insufficient implementation of standards, the delay in the reception of international law in the domestic legal order and the fulfilment of state’s international obligations. This paper aims to highlight and reflect how these ambivalences undermine undoubtedly the anchoring of the Congolese Environmental Law.
French Abstract: Depuis 1960, le droit de l'environnement en République du Congo s’est construit sur une diversité de bases juridiques. Ces dernières, bien que formulées sous l’influence de la loi du 21 mai 1962, se sont régulièrement chevauchées et superposées avant d’être cristallisées par la loi sur l’environnement du 23 avril 1991. À première vue, la loi sur l’environnement a été élaborée et a bravé l’épreuve du temps en ayant à sa lisière une équivoque, appelé « ambivalence » dans le présent article. Cette équivoque se reflète d’ailleurs dans les rapports entre la Constitution, qui rehausse le niveau de protection de l'environnement et consacre le droit des citoyens à un environnement propre et sain, et la loi sur l'environnement, qui a aujourd'hui perdu la cohérence normative voulue par le législateur en 1991. Une telle ambivalence prend la forme de la difficile adaptation de la législation aux défis de l’environnement, de la dispersion des normes et des compétences, de la mise en œuvre fastidieuse et insuffisante des normes, du retard dans l’intégration du droit international dans l’ordre juridique national et de la réalisation des objectifs de l’État ou de ses obligations internationales. Cet article a pour objet de souligner et démontrer comment ces ambivalences sapent sans aucun doute l'ancrage du droit de l'environnement congolais.
