Abstract
Comparative research expands over the traditional boundaries of constitutional law scholarship and deepens our understanding of constitutional change. This chapter addresses comparative methodology in studying constitutional change. Discussion in this chapter is based on a theoretically and methodologically broad and flexible view shunning a narrow legal perspective. Chapter addresses the methodology of comparative law, the purposes of comparative constitutional law, and the purposes of studying constitutional change comparatively. Also universalism and culturalism, the potential relevance of legal families, and legal transplants are highlighted. It is argued that both qualitative and quantitative research methods can be used and that comparative study of constitutional change allows different intellectual styles.
