Abstract

French Abstract: Le standard de l’Etat de droit est apparu, en droit de l’Union européenne, sous la forme de la « Communauté de droit », devenue « l’Union de droit ». Pendant longtemps, c’est un standard que la Cour de justice appliquait à l’Union elle-même, en particulier pour assouplir l’accès à son propre prétoire. L’expression « Etat de droit » n’apparaît quant à elle en droit de l’Union européenne qu’avec le traité de Maastricht. Elle est corrélée avec une extension de ce standard plus nettement marquée en direction des Etats membres. Au terme de ce processus, le standard de l’Etat de droit apparaît aujourd’hui en droit de l’Union comme étant, d’une part, le vecteur d’une extension limitée de l’accès au prétoire de la Cour de justice et, d’autre part, un élément d’un ordre public de l’Union européenne opposable aux Etats membres.

English Abstract: The Rule of Law standard in European Union Law first appeared in the case-law of the Court of Justice, with the expression "Community based on the rule of Law", which has since become "Union based on the rule of law". For a long time, it was a standard that the Court of Justice applied to the Union itself, in particular to broaden the access to its own courtroom. The expression "rule of law" only appeared in EU written law with the Maastricht Treaty. It was correlated with a clear extension of this standard towards the Member States. Nowadays, the rule of law standard in EU Law appears as both the vector of a limited extension of the access to the courtroom of the Court of Justice and as an element of a Public Order of the European Union, opposable to Member States.
