Abstract

German Abstract: Die vorliegende Abhandlung befasst sich mit der Geltendmachung der Entschädigungsansprüche aus Staatshaftung für unionsrechtswidrige Gerichtsentscheidungen im Lichte des polnischen Rechts. In diesem Kontext wird das Problem der Feststellung der Rechtswidrigkeit einer Gerichtsentscheidung in einem entsprechenden Verfahren besprochen. Die Autorin analysiert das durch den polnischen Gesetzgeber bestimmte Erfordernis der präjudiziellen Feststellung der Rechtswidrigkeit einer Gerichtsentscheidung aus der Perspektive der verfassungs- und unionsrechtlichen Vorgaben.

English Abstract: This paper deals with the assertion of compensation claims from state liability for judicial decisions contrary to European Union law in the light of Polish law. In this context the problem of the declaration of unlawfulness of a final judgment in the course of appropriate proceedings is discussed. The author analyzes the provision laid down by the Polish legislator for the prejudicial declaration of unlawfulness of a final judgment from the perspective of constitutional and European Union law requirements.
